The fifth amendment of the constitution allows the federal government to seize private land for the good of the public. This is called eminent domain. There are several examples of both the supreme and appealet courts upholding this as long as it is for a "just compensation" as stated in the amendment. Now, because I'm living in Oklahoma for a couple of months, I've missed the news going on at home. Nevetheless, as the question is posed, there is a lot of information we don't have. How much private land will this take up? What kind of private land will this take up? Will the pipeline be underground - allowing for the possibility for people to retain ownership of their property? What are the benefits for this pipeline being installed? Since I don't know the answers to any of these questions, I have no real opinion on the matter.
